Terms of Use

These Terms of Use govern your access to and use of the MarkScope app and the MarkScope website. By using MarkScope, you agree to these terms.

1. License and Access

Subject to these terms, MarkScope grants you a limited, revocable, non-exclusive, non-transferable right to use the app and website for their intended purpose. MarkScope and its underlying software, branding, design, and content remain the property of their respective owners.

2. Acceptable Use

You agree not to:

  • copy, redistribute, sublicense, or commercialize MarkScope except where applicable law or a separate written agreement permits it;
  • reverse engineer, decompile, or attempt to extract source code except to the extent such restrictions are prohibited by law;
  • use MarkScope in a way that interferes with the website, hosting infrastructure, or app distribution channels;
  • use MarkScope to violate the rights of others or applicable law.

3. Your Files and Content

MarkScope is a local-first Markdown app with optional Pro features. Files you choose to open remain your responsibility. You are responsible for making sure you have the right to store, view, edit, export, and manage any files you open with the app. If you enable Workspace, files stored in the dedicated MarkScope Workspace folder in iCloud Drive remain your responsibility as well.

4. Local Storage and Device Behavior

The app may store local settings, recent files, starred files, bookmarks, cache data, Workspace state, Pro purchase state, AI configuration, and AI session history on your device so it can function offline and reduce repeated prompts. You are responsible for your own backups and device security. MarkScope is not a managed cloud backup service.

5. Paid Features and Purchases

Some features are available only through MarkScope Pro, which is offered as a one-time in-app purchase where supported. Apple App Store or Google Play billing terms may also apply to those transactions, restores, and related platform services.

6. AI Features and Third-Party Providers

AI features are optional. If you configure them, your prompts and relevant document or workspace content may be sent directly from your device to the supported third-party AI provider you choose, such as OpenAI, Anthropic, DeepSeek, or OpenRouter. You are responsible for the credentials you enter, for your use of that provider, and for complying with any terms, privacy policies, and applicable laws that govern the provider's service.

7. Availability and Updates

MarkScope may change, suspend, or discontinue features at any time. App updates may be required to maintain compatibility with iOS, Android, browsers, or hosting environments.

8. Third-Party Components and Links

MarkScope may rely on third-party open-source components, app stores, operating-system services, iCloud Drive, third-party AI providers including OpenAI, Anthropic, DeepSeek, and OpenRouter, and hosting infrastructure. Those third parties may have their own terms and privacy policies. MarkScope is not responsible for third-party services that it does not control.

9. Intellectual Property

The MarkScope name, product design, branding, and software are protected by intellectual-property law and by any licenses or notices published with the product. Except for the limited right to use the app and website, these terms do not grant you any ownership or broader license rights.

10. Disclaimer of Warranties

MarkScope is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, noninfringement, availability, or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law, MarkScope and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising out of or related to your use of the app or website.

12. Termination

These terms remain in effect until they are terminated. You may stop using MarkScope at any time. MarkScope may suspend or terminate access to the website or future services if necessary to protect the product, infrastructure, or users.

13. Changes to These Terms

MarkScope may revise these terms from time to time. Updated terms become effective when published with a new effective date.
